23andMe voluntarily filed for Chapter 11 bankruptcy protection to facilitate a sale process to maximize the value of its business. The company received permission from a judge to try to sell its most valuable asset, customers' DNA data.

I remind Californians to consider invoking their rights and directing 23andMe to delete their data and destroy any samples of genetic material held by the company. Californians can request that 23andMe delete their account information, revoke permission for genetic data to be used for research, and separately request destruction of their physical test sample.

Twenty-eight state attorneys general filed suit in federal bankruptcy court to block the transfer of genetic data without explicit customer consent, arguing that 23andMe lacked legal authority to treat biological samples and genotype data as freely transferable assets.

Chapter 11 bankruptcy provides a business with a mechanism to reorganize while selling certain assets. Customer data is one asset that can be sold as part of this process.
